Welcome to cyclingpassion.us. These Terms & Conditions govern your access to and use of cyclingpassion.us, our mobile applications, and any related services (collectively, the "Services"), effective as of October 27, 2025, at 02:46 AM CDT. By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services. We operate from our headquarters in Davenport, FL.

SECTION 1 – ACCEPTANCE OF TERMS

By creating an account, placing an order, or using the Services, you confirm that you are at least 18 years old and agree to these Terms, our Privacy Policy, and all other policies referenced herein. If you are using the Services on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.

SECTION 2 – USE OF THE SERVICES

Permitted Use: You may use the Services to browse products, place orders, and contact support. All e-bikes ship from our Davenport, FL warehouse at 113 Ivy Brook Ct within 4-8 business days.

Prohibited Use: You agree not to:

  • Copy, reproduce, or distribute any content without permission

  • Use the Services for illegal purposes or to violate local e-bike laws

  • Attempt to hack, disrupt, or overload our systems

  • Resell products without written authorization from CYCLING PASSION

  • Post false reviews or engage in fraudulent activity

SECTION 3 – ACCOUNTS

To place an order, you must create an account with accurate information. You are responsible for maintaining the confidentiality of your account credentials. Notify us immediately at contact@cyclingpassion.us if you suspect unauthorized access. We reserve the right to suspend or terminate accounts for violations.

SECTION 4 – ORDERS AND PAYMENT

Order Placement: All orders are subject to availability and acceptance. We accept Klarna, Affirm, PayPal, Apple Pay, and Google Pay. Prices are in USD and include taxes based on your shipping address.

Payment: Full payment is required at checkout unless using approved financing. We are not responsible for declined payments due to insufficient funds or expired cards.

Shipping: Orders ship in 4-8 business days from Davenport, FL. See our Shipping Policy for details. Title passes upon delivery.

Cancellations: Orders may be canceled before processing. Contact +1 (863) 420-9701 within 24 hours of purchase.

SECTION 5 – PRODUCTS AND WARRANTY

Product Descriptions: We strive for accuracy, but specifications may vary slightly. See product pages for details.

Warranty: All e-bikes come with a 2-year limited warranty covering manufacturing defects. Excludes normal wear, misuse, or accidents. See Refund and Return Policy for warranty claims.

Compliance: E-bikes must comply with local laws. Riders are responsible for helmets and licensing where required.

SECTION 6 – INTELLECTUAL PROPERTY

All content, logos, and designs are owned by CYCLING PASSION or our licensors. You may not use trademarks or copyrighted materials without permission. Unauthorized use may result in legal action.

SECTION 7 – USER CONTENT

Reviews and photos you submit become CYCLING PASSION property. You grant us a worldwide, royalty-free license to use them. We may remove inappropriate content at our discretion.

SECTION 8 – LIMITATION OF LIABILITY

To the fullest extent permitted by law, CYCLING PASSION is not liable for indirect, incidental, or consequential damages. Our total liability shall not exceed the amount you paid for the product. Some states do not allow limitations, so this may not apply to you.

SECTION 9 – INDEMNIFICATION

You agree to indemnify CYCLING PASSION against claims arising from your use of the Services, violation of these Terms, or infringement of third-party rights.

SECTION 10 – TERMINATION

We may suspend or terminate your access for violations. Upon termination, your right to use the Services ends immediately.

SECTION 11 – GOVERNING LAW

These Terms are governed by Florida law. Disputes shall be resolved in Polk County, Florida courts.

SECTION 12 – CHANGES TO TERMS

We may update these Terms. Continued use after changes constitutes acceptance. The latest version is posted on cyclingpassion.us.

SECTION 13 – MISCELLANEOUS

These Terms constitute the entire agreement. If any provision is invalid, the remainder remains effective. No waiver of rights unless in writing.
